Does Every Employer have to carry Workers’ Compensation Insurance?

No. State law generally provides exceptions for very small companies. In addition, self-employed people and independent contractors are generally not covered under Workers’ Compensation law. Federal employees are covered under the federal Workers’ Compensation system. But for employers that are legally required to carry insurance, failure to carry it could result in penalties from the state, as well as lawsuits from injured employees.
